Terms of Agreement

  1. (You) as the Client/customer are legally bond to these Terms of Agreement if you signed/dated our proposal contract. This is our Terms for any and all clients or customers that have hired ElmWood Flooring that have active contract with (US) ElmWood Flooring. If covered by warranty, the only cost to ‘You’ the customer is a onetime charge of ($95.00) Ninety-Five dollars ‘office fee’ and a one time ($50.00) ‘call out travel fee’ for coming out to your home or business. Any materials needed and labor will be paid for by ElmWood Flooring as well as all daily expenses to fix the problem or what is covered under the warranty. Work/fixing the problem cannot surpass (1-2) days at (5) hours a day for any fixes or repairs, anything beyond this will cost extra.

  2. An ElmWood Flooring Rep. will explain to you about the Warranty, and what is covered. If not covered, you will have a choice to have us proceed with fixing the problem for a fee, and a representative from our company will tell you how much the labor & material will cost to complete the project. A twenty dollar call out travel fee ($20.00, $40.00 or $50.00) must be paid to ElmWood Flooring for having us out at your home or business if not covered under warranty. ElmWood Flooring guarantees all flooring installation labor for one year from the date of installation, as long as the original purchaser of the flooring occupies the building. All product warranties are the responsibility of the manufacturer. Our Warranty does not cover the following items: Damage related to abuse of the covered items by any person or people, pets, etc. Damage resulting from floods, water damage, subgrade moisture conditions, or acts of God; Damage related to customer’s failure to control humidity and temperature levels within the home or business, damage caused by structural conditions of the building. Damages caused by mold are the responsibility of the owner/purchaser to maintain any type of flooring by following the particular manufacturer maintenance guidelines. ElmWood Flooring endorses each particular manufacturer that we use, and any disclaimers and exclusions become a part of our installation labor warranty.
  3. Work to be done by others, outside contractors: All necessary permits are the responsibility of the home/ business owner if needed, before ElmWood Flooring or others start any work. If the owner/s chooses not to get a permit this decision is on the property owner, the owner is solely responsible for paying any and all fines, all violations, and fees incurred by not having a permit/permits that may be needed from the local government before starting any project that may need a permit.
  4. All material is guaranteed and carries a one-year limited warranty or as specified on the contract. All work is to be completed in a professional manner according to the standards and practices. Any extra work beyond what is in writing, alteration or deviation from the specifications in the contract involving extra costs will be executed only upon written orders and will become an extra charge over and above the estimate or signed contract. All agreements contingent upon strikes, accidents or delays beyond our control. The owner is responsible to carry fire, tornado and other necessary insurance on the home, business, and or building structure that ElmWood Flooring will be working in.
  5. This agreement does not cover any other work, above and beyond the work to be provided by ElmWood Flooring and completed by us; ElmWood will only provide what is in writing on the proposal/ contract, make sure you read this and your contract first before signing.
  6. ElmWood is not responsible for any labor or material, due to work performed by others, or if our work has been altered or tampered with.
  7. This agreement does not cover any work or changes, which at some future date may be required by government regulations, codes, or insurance regulations that may fall upon the customer’s business or home.
  8. No service will be rendered under this agreement if the customer has an outstanding past due balance owed.
  9. This agreement is not in effect until payment is made as proposed and the acceptance of our proposal/contract is signed and dated by the homeowner, customer, vendor, subcontractor and a representative of ElmWood Flooring approves the work to be done.
  10. In the event of a breach hereof, ElmWood Flooring shall be entitled to receive all costs and expenses, including reasonable attorney fees incurred, plus interest on top of what is due of 29.98% on the total amount unpaid beginning at the date of breach, in the collection of any sum or obligation due hereunder.
  11. Obtaining permits are the responsibilities of customers unless specifically proposed in agreement. ElmWood Flooring is not responsible for pre-existing code violations, and unless otherwise specified, this agreement does not include any remedies for those code violations. These remedies, if required, will be charged as an addition to this agreement.
  12. Any other work performed by ElmWood Flooring arising from unforeseen conditions and not proposed in this agreement or on the contract the work/jobsite will be billed on a time and material basis, upon customer approval.
  13. Warranty work will only be scheduled during regular working hours, Monday through Friday, 10:30 a.m. to 3:30 p.m. except holidays. After hours or weekend scheduling is available for customers for an additional charge of $195.00 and office fee of $95.00
  14. If any part of this agreement is deemed legally invalid, all other provisions remain binding on the parties with contract with ElmWood.
  15. Any and all guidelines, terms, rules and regulations of ElmWood Flooring are subject to change at any given time with or without notice to clients and or any customers.
